This website, exendstore.com (the “Site”), is operated by Exend Apparel LLC, doing business as Exend (Extraordinary Ending) (“Exend,” “we,” “us,” or “our”). Exend is an apparel and lifestyle brand — we design, produce, and sell clothing, accessories, and related products directly to individual customers. These Terms of Use, together with our Privacy Policy, Refund Policy, Legal Notices, and any other policy referenced here (collectively, the “Terms”), govern your access to and use of the Site and your purchase of any product from us.

By visiting the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site. We may update these Terms from time to time by posting a revised version here; continued use of the Site after an update means you accept the changes.

Our store is hosted on Shopify Inc., which provides the e-commerce platform, checkout, and payment processing that let us sell products to you. Shopify's own terms and privacy practices also apply to aspects of the checkout process.

Section 1 — Eligibility

You must be at least the age of majority in your state, province, or country of residence to place an order, or have a parent or legal guardian's consent to do so. By using the Site you represent that you meet this requirement.

We reserve the right to refuse service to anyone, at any time, for any lawful reason — for example, suspected fraud, abuse of our return policy, or violation of these Terms.

Information you submit through the Site may be transmitted over open networks and may be adapted for technical requirements of those networks. Payment card information is always encrypted in transit and handled by our payment processor; we do not store full card numbers on our own systems.

You agree not to reproduce, duplicate, copy, resell, or otherwise exploit any part of the Site, our content, or our products for commercial purposes without our express written permission.

Section 3 — Accuracy of Site Content

We work to keep product descriptions, imagery, sizing information, and pricing accurate and current, but errors can occur. Colors may also appear differently depending on your device's display. We are not liable if content on the Site is occasionally inaccurate, incomplete, or out of date, and any reliance on Site content is at your own risk.

We may update or correct Site content at any time without obligation to notify you, except where required by law.

Section 4 — Products, Pricing, and Availability

Products offered by Exend are frequently released as limited drops with a fixed number of units per size, colorway, or edition. Once a limited item sells out, it may not be restocked; where that is the case, the product page will say so.

Prices are subject to change without notice, and we reserve the right to modify, limit, or discontinue any product or the Site itself at any time. We are not liable to you or any third party for such changes.

We reserve the right to limit order quantities per person, household, or order, and to refuse or cancel orders we reasonably believe are fraudulent, abusive of a promotion, or intended for unauthorized resale. If we cancel or change an order, we will attempt to notify you using the contact details provided at checkout.

You agree to provide accurate, current billing, shipping, and account information, and to promptly update it as needed so we can fulfill your order and reach you if there is an issue.

Section 5 — Returns and Exchanges

Section 6 — Optional Third-Party Tools and Links

The Site may link to, or let you use, tools and content provided by third parties (for example, payment processors, social platforms, or embedded media) that we do not control. We provide access to these “as is” and without warranty, and we are not responsible for their content, accuracy, or practices. Review any third party's own terms before relying on their tools.

Links to third-party sites do not imply endorsement, and we are not responsible for the content or practices of sites we do not operate.

Section 7 — User Submissions

If you send us comments, photos of you wearing Exend product, testimonials, or other creative submissions (for example, tagging us on social media or replying to a request for user photos), you agree we may use, reproduce, and share that submission — with credit where practical — in our marketing, on the Site, and on our social channels, without additional compensation, unless we've agreed otherwise with you in writing.

You're responsible for making sure anything you send us doesn't infringe someone else's rights and isn't unlawful, obscene, or abusive. We may, but are not obligated to, remove any submission at our discretion.

Section 8 — Personal Information

Our collection and use of personal information in connection with the Site and your orders is described in our Privacy Policy.

Section 9 — Errors and Corrections

The Site may occasionally contain typographical errors or inaccuracies related to product details, pricing, or availability. We reserve the right to correct these and to cancel or adjust orders affected by a pricing or availability error, even after an order has been placed, and we'll contact you if that happens.

The Exend name, the Extraordinary Ending name, the Exend wordmark, the flying panther and United Africa badge marks, Activf, Proximity, Pitchborn, Born to Play, and related logos are trademarks of Exend Apparel LLC (registered or unregistered, as applicable). Section 12 — Disclaimer of Warranties; Limitation of Liability

The Site and its content are provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We don't guarantee the Site will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, Exend Apparel LLC and our officers, employees, and contractors will not be liable for indirect, incidental, or consequential damages arising from your use of the Site or our products. Some jurisdictions don't allow these limitations, so they may not apply to you in full.

Section 13 — Indemnification

You agree to indemnify and hold Exend Apparel LLC, our affiliates, officers, and employees harmless from any claim arising from your breach of these Terms or your violation of any law or third-party right.

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. We may suspend or terminate your access to the Site for violating these Terms, without notice.
